1. Agreement to Terms

By accessing or using the website, services, client portal, or any communications (including SMS) of Wasatch Credit Consulting, LLC (“Company,” “we,” “our,” or “us”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must immediately discontinue use of our services and website. These Terms constitute a legally binding agreement between you and Wasatch Credit Consulting, LLC, a Utah limited liability company with its principal place of business at 2795 E. Cottonwood Parkway, Suite 300, #1156, Salt Lake City, Utah 84121.

2. Consumer Credit File Rights Under State and Federal Law

Pursuant to the Credit Repair Organizations Act, 15 U.S.C. Section 1679c(a)

YOU HAVE THE FOLLOWING RIGHTS UNDER STATE AND FEDERAL LAW:
  1. You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor a credit repair company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for up to 10 years.
  2. You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.
  3. You have a right to sue a credit repair organization that violates the Credit Repair Organizations Act. This law prohibits deceptive practices by credit repair organizations.
  4. You have the right to cancel your contract with any credit repair organization for any reason within three (3) business days from the date you signed it.
  5. Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate. However, mistakes may occur. You may, on your own, notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information. The credit bureau may not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.
  6. If the credit bureau’s reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate. The credit bureau must include a summary of your statement about disputed information with any report it issues about you.

3. Credit Repair Organizations Act (CROA) Disclosure

Pursuant to the Credit Repair Organizations Act (15 U.S.C. Section 1679 et seq.):
  • You have the right to dispute inaccurate information in your credit report directly with credit reporting agencies at no charge to you.
  • You have the right to cancel your contract with Wasatch Credit Consulting, LLC without any penalty or obligation within three (3) business days from the date you sign the contract.
  • You have the right to receive a written contract before any services are performed, detailing the specific services to be provided, the total cost, and the timeframe.
  • You have the right to sue a credit repair organization that violates the Credit Repair Organizations Act.

IMPORTANT NOTICE: No person or entity can legally guarantee the removal of accurate and timely negative information from your credit report. Credit reporting agencies are required to follow reasonable procedures to ensure the accuracy and completeness of the information contained in your credit reports.

4. Description of Services

Wasatch Credit Consulting, LLC provides credit repair, credit restoration, and credit education services, including but not limited to:
  • Comprehensive analysis and review of credit reports from Equifax, Experian, and TransUnion
  • Identification and assessment of inaccurate, incomplete, misleading, unverifiable, or outdated information
  • Preparation, submission, and tracking of dispute letters to credit reporting agencies, creditors, collection agencies, and other data furnishers
  • Ongoing monitoring and follow-up on dispute outcomes and credit bureau responses
  • Negotiation and communication with creditors and collection agencies on your behalf
  • Credit education, coaching, and financial literacy guidance
  • Progress reporting and credit score monitoring throughout the engagement

5. Eligibility

To use our services, you must:
  • Be at least eighteen (18) years of age
  • Be a legal resident of the United States
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate, truthful, and complete information as required
  • Not be using our services for any fraudulent, illegal, or unauthorized purpose

6. Client Responsibilities

To ensure the effectiveness of our services, you agree to:
  • Provide accurate, complete, and truthful information, including but not limited to your full legal name, Social Security Number, date of birth, current address, and all relevant financial information
  • Respond promptly to our requests for additional information or documentation
  • Notify us immediately of any changes to your contact information, address, or financial situation
  • Refrain from opening new credit accounts, applying for new credit, or making significant financial changes without first consulting with our team
  • Keep all login credentials, passwords, and account access information confidential and secure
  • Review all correspondence, dispute results, and progress reports we provide to you
  • Notify us promptly of any direct communications you receive from credit bureaus, creditors, or collection agencies regarding disputes we have initiated
  • Cooperate fully and in good faith throughout the credit repair process

7. Fees and Payment

  • All fees, costs, and payment terms will be set forth in your individual service agreement
  • A non-refundable enrollment or setup fee may be due upon signing your service agreement
  • Monthly service fees are billed on a recurring basis as specified in your service agreement
  • In compliance with the Credit Repair Organizations Act, we do not charge or receive any fee or other consideration for any service before such service is fully performed
  • You may cancel your services at any time; no refunds will be issued for partial service periods
  • If payment is not received when due, we reserve the right to suspend or terminate your services upon reasonable written notice
  • All fees are exclusive of any applicable taxes, which shall be your responsibility

8. Right to Cancel

You may cancel your contract with Wasatch Credit Consulting, LLC without any penalty or obligation within three (3) business days from the date on which you execute the contract. To cancel, you must mail or deliver a signed, dated written cancellation notice to:

Upon cancellation within the three (3) business day period, we shall return to you all money paid by you within five (5) business days after receipt of your cancellation notice.

After the three (3) business day cancellation period, you may still cancel at any time by providing written notice. Cancellation after the initial period will be effective at the end of your current billing cycle, and no refund will be issued for services already rendered or fees already earned.

9. No Guarantees; Disclaimer of Results

WE DO NOT AND CANNOT GUARANTEE ANY SPECIFIC RESULTS. While we work diligently and professionally on your behalf, credit repair outcomes are inherently uncertain and depend on numerous factors beyond our control, including but not limited to:
  • The nature, accuracy, and age of the items on your credit report
  • The responses, policies, and practices of the credit reporting agencies
  • The responses and cooperation of individual creditors, collection agencies, and data furnishers
  • Changes in applicable laws, regulations, or credit reporting standards
  • Your individual financial behavior and credit activity during the engagement
No representation, warranty, or guarantee has been made regarding the amount of improvement to your credit score, the number of items that will be removed or corrected, or the timeframe within which any results will be achieved. Any projections, estimates, or examples of past results are provided for illustrative purposes only and do not constitute a guarantee of future results.

10. SMS Communications and Consent

A. Consent

By providing your phone number and opting in to receive SMS communications from Wasatch Credit Consulting, LLC, you expressly consent to receive text messages from us at the phone number you provide. This consent is not a condition of purchasing any goods or services.

B. Types of SMS Communications

If you have consented to receive text messages, you may receive SMS communications related to:
  • Credit repair service updates and progress notifications
  • Appointment reminders and scheduling confirmations
  • Account and billing notifications
  • Important updates regarding your credit disputes
  • Responses to your inquiries or requests for information

C. Message Frequency

Message frequency may vary depending on the type of communication and the status of your credit repair engagement.

D. Standard Messaging Disclosures

  • Message and data rates may apply depending on your mobile carrier’s pricing plan
  • Messaging frequency may vary based on your account activity and service needs
  • You can opt out at any time by texting STOP to the number from which you received the message

E. Potential Fees

Standard message and data rates may apply as determined by your wireless carrier. These fees may vary for domestic and international messages. Wasatch Credit Consulting, LLC is not responsible for any charges imposed by your mobile carrier.

F. Opt-In Methods

You may opt in to receive SMS messages in the following ways:
  • By checking the SMS consent checkbox on our website contact form or client intake form
  • Verbally, during a telephone conversation with our team
  • By submitting an online form that includes SMS consent
  • By filling out and signing a paper enrollment form

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WASATCH CREDIT CONSULTING, LLC, OR ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE “COMPANY PARTIES”) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
  • Loss of profits, income, revenue, or business opportunities
  • Loss of data or information
  • Loss of goodwill or reputation
  • Personal injury or property damage
  • Damages arising from reliance on any information provided through our services or website
  • Any other intangible losses

WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTORY LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE COMPANY PARTIES EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO WASATCH CREDIT CONSULTING, LLC DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

15. Disclaimer of Warranties

THE SERVICES AND WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

16. Indemnification

You agree to indemnify, defend, and hold harmless Wasatch Credit Consulting, LLC, and all of its officers, directors, members, managers, owners, agents, employees, information providers, attorneys, licensors, and affiliates (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to:
  • Your breach of any provision of these Terms
  • Your use or misuse of our services or website
  • Your violation of any applicable law, regulation, or third-party right
  • Any information you provide to us that is false, misleading, inaccurate, or incomplete
  • Any negligent or wrongful act or omission by you

17. Dispute Resolution

A. Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. The parties shall use their best efforts to resolve any dispute through good faith negotiations for a period of not less than thirty (30) days.

B. Binding Arbitration

If the parties are unable to resolve a dispute through informal negotiation, any dispute, claim, or controversy arising out of or relating to these Terms shall be determined by binding arbitration in Salt Lake County, Utah, before a single arbitrator, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitrator’s decision shall be final and binding.

C. Class Action Waiver

YOU AND WASATCH CREDIT CONSULTING, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

D. Exceptions

Either party may seek injunctive or equitable relief in any court of competent jurisdiction. Nothing in this provision shall prevent you from bringing issues to the attention of federal, state, or local agencies, including the Federal Trade Commission or the Consumer Financial Protection Bureau.

E. Preservation of CROA Rights

Nothing in these Terms shall be construed to limit, waive, or restrict your rights under the Credit Repair Organizations Act (15 U.S.C. Section 1679 et seq.), including your right to sue a credit repair organization that violates the CROA.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. To the extent that any legal proceeding is not subject to arbitration, the sole and exclusive jurisdiction shall be the state or federal courts located in Salt Lake County, Utah.

19. Severability

Should any provision of these Terms be declared invalid, unenforceable, or void, such determination shall not affect the validity or enforceability of any remaining provision. The remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any individual service agreement you execute with us, constitute the entire agreement between you and Wasatch Credit Consulting, LLC regarding the subject matter hereof.

21. Waiver

The failure of Wasatch Credit Consulting, LLC to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations without restriction.

23. Force Majeure

Wasatch Credit Consulting, LLC shall not be liable for any failure or delay in performing its obligations if such failure or delay results from circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, war, terrorism, labor disputes, power failures, internet failures, or cyberattacks.

24. Electronic Communications

By using our services and providing your contact information, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

25. Accessibility

These Terms of Service are available at all times on our website and within any client portal we provide.

26. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of our services after any modifications constitutes acceptance of the revised Terms.

27. Termination

We reserve the right to suspend or terminate your access to our services and/or website at any time, with or without cause, and with or without notice. Upon termination, your right to use our services shall immediately cease. All provisions that by their nature should survive termination shall survive.
